Trained To Go — Mobile App Terms of Use

1. Agreement

1.1 These Terms of Use govern your download, installation, and use of the Trained To Go mobile application ("App"). By using the App you agree to these Terms of Use and to the TTG Terms & Conditions (including the Assumption of Risk, Waiver, Release & Indemnity, and Privacy Policy), which are incorporated into and form part of these Terms of Use. If there is any inconsistency, the TTG Terms & Conditions prevail.

1.2 You must be at least 18 years of age to use the App. The App is not offered to persons under 18.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on a device you own or control, for your personal, non-commercial use, subject to these Terms of Use.

3. Health Warning

The App delivers general fitness programming, not medical advice. Training carries inherent and obvious risks, which you assume as set out in clauses 4–9 of the TTG Terms & Conditions. Consult a medical practitioner before starting any program.

4. Acceptable Use

You must not: (a) copy, redistribute, resell, or republish App content; (b) reverse engineer, decompile, or tamper with the App; (c) use the App unlawfully or to harass, abuse, or harm others; (d) upload malicious code; (e) misrepresent your identity; or (f) share your account. We may suspend or terminate access for breach.

5. Content and Intellectual Property

All content in the App is owned by or licensed to Megalife Pty Ltd. Community content you post remains subject to the Community Standards and the media and marketing consent in clause 13 of the TTG Terms & Conditions.

6. Subscriptions and Purchases

Purchases made through the App or linked checkout are subject to the payment, subscription, cancellation, and refund terms in the TTG Terms & Conditions. Purchases made via the Apple App Store or Google Play are also subject to those platforms' terms; refunds for such purchases are handled per the platform's process, subject to your rights under the Australian Consumer Law.

7. Third-Party Services

The App is hosted and delivered via Kajabi and may link to third-party sites and tools. We are not responsible for third-party content or services; your use of them is at your own risk and subject to their terms.

8. Availability

We do not promise the App will be uninterrupted or error-free. We may modify, suspend, or discontinue features. Nothing in this clause limits your rights under the Australian Consumer Law.

9. Liability

Liability for the services delivered through the App (which are recreational services) is excluded, released, limited, and indemnified as set out in clauses 6–9 of the TTG Terms & Conditions, to the full extent permitted by law, including section 139A of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms of Use excludes rights that cannot lawfully be excluded.

10. Privacy

Our collection and handling of your personal information is described in the Privacy Policy in clause 16 of the TTG Terms & Conditions, in accordance with the Privacy Act 1988 (Cth).

11. Changes

We may update these Terms of Use; the current version, with its effective date, will always be available in the App or at trainedtogo.life. Material changes will be notified. Continued use after notice constitutes acceptance.

12. Governing Law

These Terms of Use are governed by the laws of Queensland, Australia. You and we submit to the exclusive jurisdiction of the courts of Queensland, Australia.
